These Terms of Service ("Terms") govern your use of our website, waitlist, and gear rental subscription service. By joining our waitlist or purchasing a subscription, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. Please read them carefully before proceeding.
This is a binding agreement between you — the parent or legal guardian — and HeyBuddy Outdoors, LLC ("HeyBuddy," "we," "us," or "our").
HeyBuddy Outdoors is a seasonal outdoor gear rental service for families with children ages 5–10. Subscribers receive curated gear kits selected for their child's age, size, and adventure profile. Gear is rented — not sold — and is expected to be returned at the end of each rental period or when a swap is requested. Specific items shown in promotional materials are examples only and are not guaranteed.
We operate as a gear library: you borrow high-quality equipment for the season, return it, and swap into new gear as your child grows or their interests change. This model lets families access great gear without the upfront cost, storage burden, or guilt of outgrown purchases.
Current service area: We currently serve the Atlanta metro area. We reserve the right to decline or cancel orders outside our active service area and will notify you before charging your payment method if your address is not serviceable.
You must be at least 18 years old and a parent or legal guardian of the child(ren) who will use the service. By completing a purchase, you confirm this and accept responsibility for your account, your payment, for supervising any child who uses the gear, and for returning gear in accordance with these Terms.
Because this service is designed for children, we take privacy seriously. We do not knowingly collect personal information from children under 13. All account creation, purchases, and communications are handled by the parent or guardian. See our Privacy Policy for details. If you believe we have inadvertently collected information from a child without parental consent, contact us immediately at mike@heybuddyoutdoors.com.
To manage your subscription and gear rentals, you will create a password-protected account. You are responsible for all activity under your account. Keep your login credentials secure and notify us immediately of any unauthorized access. You agree to provide accurate, current information — including child profile details such as age, size, and interests — and to update it as your child grows. We reserve the right to suspend or terminate accounts that provide false information or are being misused.
Recurring charges: By purchasing a subscription, you authorize HeyBuddy Outdoors to charge your payment method on a recurring monthly basis, beginning on the date you first subscribe and renewing each month on that same date, until you cancel. You acknowledge and accept responsibility for all recurring charges until cancellation.
Your subscription tier determines how many gear swaps you may request per year. A swap means returning your current gear kit and selecting a new one.
All gear rented through HeyBuddy Outdoors remains our property and must be returned. You are responsible for returning gear promptly when you request a swap, cancel your subscription, or when your subscription otherwise ends.
We understand gear gets used — that's the point. We distinguish between normal wear and damage that reduces the gear's useful life or makes it unsafe for the next family.
Normal wear (no charge): Minor surface scuffs, light fading from sun exposure, small dirt stains that clean off, and general signs of appropriate outdoor use.
Damage (fee applies): Broken components, bent or cracked frames, torn fabric beyond minor surface wear, lost items or accessories, deep gouges, and any damage that makes the gear unsafe or unusable.
We take product selection seriously. All gear kits included in our service are reviewed for age-appropriateness for children ages 5–10. However:
Joining our waitlist is free and does not constitute a purchase or rental agreement. By joining the waitlist, you agree to these Terms and our Privacy Policy. Waitlist members will receive early access and founding-member pricing when we launch. Waitlist position does not guarantee a subscription slot, but we will do our best to honor all waitlist signups at launch. You may remove yourself from the waitlist at any time by contacting us.
All content on this website — including text, images, logos, the HeyBuddy Compass platform, and activity guides — is owned by or licensed to HeyBuddy Outdoors and may not be reproduced, distributed, or used commercially without our written permission.
We reserve the right to suspend or terminate your account and subscription at any time if we determine, in our reasonable judgment, that you have violated these Terms, provided false account information, failed to return gear, or engaged in misuse or abuse of the service. If we terminate your account other than for cause, we will refund any prepaid, unused subscription fees on a prorated basis. Outstanding gear return or damage obligations survive termination.
HeyBuddy Outdoors will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, supply chain disruptions, carrier failures, pandemics, or government actions. In such events, we will notify affected subscribers and work to resume normal service as quickly as possible.
To the fullest extent permitted by applicable law, HeyBuddy Outdoors' total liability for any claim arising from these Terms or the service is limited to the amount you paid us in the most recent billing period. We are not liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms limits liability for death, personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
You agree to defend, indemnify, and hold harmless HeyBuddy Outdoors, LLC and its employees and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (i) your violation of these Terms; (ii) misuse of rented gear or failure to supervise a child using the gear; or (iii) your failure to return gear as required. This section does not require you to indemnify us for claims arising from our own negligence or defective products.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law provisions. Venue for any disputes not subject to arbitration shall be the state or federal courts located in Fulton County, Georgia.
We hope to resolve any disagreement informally. If you have a concern, please contact us first at mike@heybuddyoutdoors.com and we will make a good-faith effort to resolve it within 30 days.
If informal resolution fails, disputes will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), except that either party may bring a small claims court action for disputes within that court's jurisdictional limits. By agreeing to arbitration, you waive the right to a jury trial and to participate in a class action.
We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms. The current version will always be posted at this URL with the date last updated.
